Legal Notice and Terms of Use

Article 1. Purpose and acceptance

These Terms of Use (“Terms”) govern access to and use of the website enertopia.fr and its language versions (the “Site”). Any use of the Site constitutes acceptance of the Terms. Users who do not accept them must stop using the Site.

The Site is intended for professionals: customers, suppliers, partners and applicants.

Article 3. Access to the Site

The Site is available free of charge to any user with internet access. Access and equipment costs remain the user’s responsibility.

ENERTOPIA may suspend, restrict or interrupt access to the Site, in particular for maintenance, without notice or compensation. It may also modify or remove any content from the Site at any time.

Article 4. Rules of use

The user agrees to use the Site fairly and in compliance with applicable laws. In particular, it is prohibited to:

• extract or copy the Site’s content by automated means (robots, site scrapers, scraping);
• attempt to gain unauthorized access to ENERTOPIA’s systems, or test the security of the Site without written consent;
• introduce a virus or any malicious code, or disrupt the operation of the Site;
• impersonate a person or a company, or send unsolicited messages;
• use the Site for fraudulent purposes or purposes contrary to public order.

Article 5. Product information

The Site presents ENERTOPIA’s activities, product range, partner manufacturers and certifications. This information is provided for indicative purposes only. It does not constitute a commercial offer.

Product photographs and visuals are not contractually binding. Technical characteristics come from the manufacturers and may change without notice. Only the data sheets and certificates provided with an offer are authoritative.

Any order or service is subject to a written offer and specific contractual terms, which prevail over the content of the Site.

Article 6. Export controls and sanctions

Certain products presented on the Site, in particular for the nuclear, aeronautics and space sectors, may be subject to export control rules. These rules include Regulation (EU) 2021/821 on dual-use goods, the restrictive measures of the European Union and, depending on the origin of the products, foreign regulations.

No information on the Site constitutes an export authorization. ENERTOPIA may request an end-use certificate. It may refuse any request that would not allow compliance with these rules.

Article 7. Intellectual property

The texts, images, logos, graphics, databases and structure of the Site are the property of ENERTOPIA or its partners. They are protected by the French Intellectual Property Code.

Any reproduction, representation, adaptation or distribution, in whole or in part, without the prior written authorization of ENERTOPIA is prohibited. It constitutes infringement.

The ENERTOPIA name and logo belong to ENERTOPIA. The trademarks and logos of the manufacturers mentioned remain the property of their respective owners. Their presence on the Site does not grant the user any right of use.

Article 8. Information submitted by the user

Price requests and technical information submitted by a customer are treated confidentially. They are shared only with the manufacturers concerned by the request and, if necessary, with Enertopia Korea.

Users must not submit sensitive or restricted documents (drawings, protected specifications, controlled data) without a prior confidentiality agreement.

Ideas and suggestions sent spontaneously are not covered by any confidentiality obligation. Sending them does not oblige ENERTOPIA to provide any remuneration or to make any commitment.

Article 9. Liability

The Site is provided “as is”. ENERTOPIA endeavors to publish accurate and up-to-date information, without guaranteeing the absence of errors, omissions or interruptions.

ENERTOPIA cannot be held liable for direct or indirect damages related to the use of the Site, its unavailability or the presence of a virus. The user remains responsible for protecting their equipment and data.

These limitations do not apply in cases of gross or intentional misconduct by ENERTOPIA, nor where prohibited by law.

Article 10. Hyperlinks

The Site may contain links to third-party sites, including LinkedIn and the manufacturers’ websites. These links are provided to facilitate navigation. ENERTOPIA has no control over these sites and disclaims all responsibility for their content.

Creating a link to the Site’s home page is permitted, provided the Site is not reproduced within a frame (framing) and the presentation is not misleading. ENERTOPIA may request the removal of any link.

Article 11. Reporting unlawful content

Anyone may report content they consider unlawful to paris@enertopia.fr. The report must state the identity of its author, the page concerned and the grounds for the requested removal. ENERTOPIA processes each report as promptly as possible.

Article 12. Personal data and cookies

The processing of personal data is described in the Privacy Policy. The use of cookies is described in the Cookie Policy.

Article 13. Breach of the Terms

In the event of a breach of the Terms, ENERTOPIA may restrict or block the user’s access to the Site. It may take any appropriate legal action.

Article 14. Amendment of the Terms

ENERTOPIA may amend the Terms at any time. The applicable version is the one online on the day of consultation.

Article 15. General provisions

If a clause of the Terms is held to be void, the remaining clauses remain applicable. ENERTOPIA’s failure to rely on a clause does not constitute a waiver of the right to rely on it later.

The Site and the Terms exist in French, English, Chinese and Korean. In the event of a discrepancy between these versions, the French version prevails.

Article 16. Governing law and disputes

The Terms are governed by French law. In the event of a dispute, the parties shall first seek an amicable solution for 30 days from a written claim.

If the user is a merchant, any dispute falls under the exclusive jurisdiction of the Nanterre Commercial Court (tribunal des activités économiques), or the court that succeeds it. In all other cases, the ordinary rules of jurisdiction apply.
